The Personal Data Protection Law No. 6698 (“KVKK” or “the Law”), published in the Official Gazette No. 29677 on April 7, 2016 , aims to protect individuals’ fundamental rights and freedoms—primarily the right to privacy—in the processing of personal data. In accordance with Article 10 of the Personal Data Protection Law No. 6698 (“KVKK” or “the Law”), titled “The Data Controller’s Obligation to Provide Information,” and the “Communication on the Procedures and Principles to Be Followed in Fulfilling the Obligation to Provide Information,” published in the Official Gazette No. 30356 dated March 10, 2018 , we aim to inform you through this Privacy Notice about your personal data processed by the “Company” via the Message Management System (“ and “t integration).
2. PERSONAL DATA PROCESSED
The following personal data is processed within the scope of your relationship with the Company through the Message Management System or in connection with the Message Management System:
- Identification Information: first and last name, Turkish ID number, and—if you are a merchant or tradesman—your MERSIS number and business name;
- Your Contact Information: email address, phone number;
- Communication Records: the content of your written and electronic messages regarding complaints, suggestions, and requests; if you file a complaint, a visual sample of the commercial electronic message that is the subject of the complaint;
- Your Commercial Electronic Communication Preferences: Natural or legal person Service Providers engaged in e-commerce activities to whom you previously gave consent to send commercial electronic communications, the date and time of consent, the communication channel, the source of consent, and information indicating whether you are a merchant or tradesman; the date and time you exercised your right to opt out of commercial electronic communications, information regarding the natural or legal person Service Provider engaged in e-commerce from whom you opted out, the communication channel, and the source of the opt-out;
- Your Transaction Security Data Related to Cybersecurity: IP address, website and mobile app access logs, and other data related to cybersecurity contained within these logs;
3. PURPOSES OF PROCESSING PERSONAL DATA
Your personal data collected in connection with your relationship with the company may be processed for the purposes listed below.
- Creation and management of user accounts/profiles in the Message Management System,
- Viewing consent information and exercising the right to opt out of commercial electronic messages,
- Notifying relevant parties when consent is given or the right to opt out is exercised,
- Ensuring that consent and opt-out actions are synchronized and visible on other platforms designed for managing commercial electronic messages,
- Submitting complaints via the Message Management System regarding the sending of unauthorized commercial electronic messages,
- Ensuring the management of complaints, suggestions, and requests, and informing you of the outcome of the process,
- Enabling the obtaining of consent for commercial electronic messages, the exercise of the right to opt-out, and the management of complaint processes through the Message Management System,
- Maintaining and storing records related to consents, opt-outs, and commercial electronic messages,
- Displaying up-to-date identifying information regarding the Service Providers—whether natural or legal persons engaged in e-commerce activities—for the brands and brand rights holders for which you have given consent, exercised your right to opt out, or filed a complaint,
- Ensuring the full and proper fulfillment of our contractual and legal obligations,
- To respond to information requests from public institutions and organizations,
- To fulfill other obligations arising from legislation regarding commercial electronic communications,
- To monitor and manage legal matters,
- To use them as evidence in any disputes that may arise,
- To operate the Message Management System,
- To maintain visit log records for the purpose of implementing information security processes,
5. METHODS AND LEGAL BASES FOR COLLECTING PERSONAL DATA
The Company processes your personal data based on the legal ground that data processing is necessary for the establishment, exercise, or defense of a legal claim, in accordance with Article 5, Paragraph 2, Subparagraph (e) of the Law. Your personal data is collected and processed when you contact us through our website, e-Government integration, mobile app, or call center, and/or through service providers to whom you have given consent to receive commercial electronic communications, or through business partners working with these service providers.
6. RIGHTS OF DATA SUBJECTS WHOSE PERSONAL DATA IS PROCESSED
Pursuant to the provisions of Article 11 of the Law, you have the following rights regarding your personal data.
- To learn whether your personal data has been processed,
- If your personal data has been processed, to request information regarding such processing,
- To learn the purpose of the processing of your personal data and whether it is being used in accordance with that purpose,
- To know the third parties to whom your personal data has been transferred, whether within or outside the country,
- To request the correction of your personal data if it has been processed incompletely or incorrectly
- To request the erasure or destruction of personal data,
- To request that third parties to whom personal data has been transferred be notified of any rectification, erasure, or destruction of such data,
- To object to a decision made solely through the automated processing of personal data that adversely affects the data subject,
- To request compensation for damages suffered as a result of the unlawful processing of personal data.
